By accessing and using the omeganexa website (omeganexa.top) and analytics platform services, you accept and agree to be bound by the terms and provision of this agreement. omeganexa Ltd (Registration Number: C26248) provides analytics services for beauty salons and spa businesses under these Terms of Service.
If you do not agree to abide by the above, please do not use this service. These terms apply to all users of our website and platform, including without limitation users who are browsers, vendors, customers, merchants, and contributors of content.

Subscription fees are billed in advance on a monthly or annual basis and are non-refundable. There will be no refunds or credits for partial months of service, upgrade/downgrade refunds, or refunds for months unused with an open account.
We reserve the right to change our pricing at any time. If we change our pricing, we will provide you with reasonable advance notice. Your continued use of our services after the price change constitutes your agreement to pay the modified charges.
If payment is not received by the due date, we reserve the right to suspend or terminate your access to our services until payment is received.
The omeganexa platform, including its original content, features, and functionality, is and will remain the exclusive property of omeganexa Ltd and its licensors. The platform is protected by copyright, trademark, and other laws. Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.
You may not duplicate, copy, or reuse any portion of the HTML/CSS, Javascript, or visual design elements or concepts without express written permission from omeganexa. Any unauthorised use of our intellectual property may result in termination of your account and legal action.
You retain ownership of any content you submit, post, or display on or through our services. By submitting content, you grant omeganexa a worldwide, non-exclusive, royalty-free licence to use, reproduce, adapt, publish, translate, and distribute such content in any media for the purpose of providing our services.
In no case shall omeganexa Ltd, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers, or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation, lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability, or otherwise, arising from your use of any of our services or products procured using our services.
Because some states or jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages, in such states or jurisdictions, our liability shall be limited to the maximum extent permitted by law.
Our total liability to you for any claims arising out of or relating to these Terms of Service or our services shall not exceed the amount paid by you to omeganexa for the services during the twelve (12) months preceding the claim.
You agree to indemnify, defend, and hold harmless omeganexa Ltd and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns, and employees from any claim or demand, including reasonable legal fees, made by any third party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference, or your violation of any law or the rights of a third party.
We strive to provide reliable service availability but cannot guarantee uninterrupted access to our platform. Our services may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control.
We aim for a service availability of at least high uptime on a monthly basis, excluding scheduled maintenance windows. In the event of extended service outages, we may provide service credits at our discretion.
You acknowledge that temporary interruptions in service availability may occur and agree that omeganexa shall not be liable for any damages resulting from such interruptions.
Either party may terminate this agreement at any time with written notice. You may cancel your account at any time by contacting us or through your account settings. Upon termination, your right to use our services will cease immediately.
We may terminate or suspend your account and access to our services immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms of Service.
Upon termination of your account, we will provide you with access to export your data for a period of thirty (30) days. After this period, your data may be deleted from our systems in accordance with our data retention policies.
All provisions of the Terms of Service which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
omeganexa shall not be liable for any failure or delay in performance under these Terms of Service which is due to fire, flood, earthquake, elements of nature or acts of God, acts of war, terrorism, riots, civil disorders, rebellions or revolutions, or any other cause beyond our reasonable control.
If any provision of these Terms of Service is determined to be unlawful, void, or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service. Such determination shall not affect the validity and enforceability of any other remaining provisions.
These Terms of Service and any separate agreements whereby we provide you services shall be governed by and construed in accordance with the laws of Malta and the European Union.
Any disputes arising out of or relating to these Terms of Service or our services shall be resolved through the courts of Malta. You consent to the personal jurisdiction of such courts and waive any objection to the laying of venue in such courts.
